Testamentary capacity is the legal ability of a person to make or alter a valid will, requiring that they understand the nature of the decision, the extent of their assets, and the claims of potential beneficiaries.
To make or revoke a directive in a written will , the person must have capacity at the time of making or revoking the directive. This date and time sensitive assessment will assess the relevant persons capacity in making a specific decision.
