When a Decision-Making Representative Order is being sought, the Circuit Court may require a formal capacity assessment of the person (the "Relevant Person") whose decision-making ability is in question.

This is the most intensive level of support under the Act, used only when the person lacks capacity even with help despite all other arrangements being considered.
